An agreed settlement has ended legal action a former Missouri Baptist Convention employee filed against MBC executive director David Clippard and the convention.
On Dec. 30, former MBC controller Carol Kaylor and the convention agreed to settle Kaylor's charge of sexual harassment. According to a one-paragraph statement released by all parties, "the court...ruled in favor of the Missouri Baptist Convention finding there is no legal claim" for the charge, "[w]ith Mrs. Kaylor's consent."
U.S. District Court Judge Terry Adelman granted the parties' joint request to dismiss two additional counts on Jan. 5. The court order did not identify those counts.
The original legal action filed on Jan. 21, 2004, in Missouri's 22nd Judicial Circuit Court in St. Louis listed three counts -- libel and slander, gender discrimination and retaliation. The case was later transferred to the federal court.
According to the press release, MBC's insurance carrier, Church Mutual, agreed to pay Kaylor's attorneys. Both parties also agreed that a contribution will be made to the Lottie Moon Christmas Offering for International Missions. The release did not specify the amount or who would pay it.
Kaylor filed a discrimination complaint with the federal Equal Employment Opportunity Commission in June 2003. Clippard fired her on April 10 that year, with termination effective on April 15. The EEOC handed a formal complaint to the convention in September.
In September 2003, the former controller noted she had lodged complaints to appropriate convention personnel before seeking EEOC assistance. She said she believed her complaints prompted the changes the Executive Board made in the convention's harassment policies at its April session that year.
Kaylor withdrew the EEOC action on Oct. 24, 2004, in order to file the civil action.
Neither Kaylor nor her attorney, Michael G. Berry of Jefferson City, would comment on the outcome. Kaylor's other attorney, Morry Cole of St. Louis, could not be reached by press time Monday.
